NDIS Law Monitor 2026: a tool to help disability providers stay up to date with legal change

Amid a rapidly changing NDIS landscape, the latest edition of NDIS Law Monitor gives disability providers a plain-English summary of what has changed, what is coming and what to do about it.

 

Introduction

Keeping pace with new NDIS Commission powers, proposed structural reform of the Scheme, mandatory registration for Supported Independent Living, and changes to work health and safety and employment law is a significant challenge for providers. The harder task is often understanding what each development means operationally.

NDIS Law Monitor is a report included with from Ideagen Policy Logic designed to help disability provider boards and leaders stay on top of the many laws, regulations, guidelines and codes that apply to their operations. It is a plain-English report for boards and executives that summarises key legal, regulatory and compliance changes affecting the disability and NDIS industry.

 

What legal changes are covered by NDIS Law Monitor?

NDIS Law Monitor covers recent and upcoming legal and regulatory changes affecting the disability industry across all Australian jurisdictions. This means it covers everything from Western Australian restrictive practices policy to national paid parental leave entitlements for workers, alongside the NDIS-specific reforms that affect providers directly.

 

What period of time is covered by NDIS Law Monitor?

NDIS Law Monitor is delivered twice a year, with the latest edition covering the period 1 December 2025 to 31 July 2026.

 

Does NDIS Law Monitor tell me which legal changes are the most important?

Yes. NDIS Law Monitor uses a colour-coded "traffic light" system so you can see at a glance whether each legal change requires you to:

  • Check and update your policies and procedures
  • Watch and prepare for further developments that have not happened yet; or
  • Make note of the change without needing to take any specific action

 

Does NDIS Law Monitor explain the changes in plain English?

Absolutely. Here is an example from the latest edition:

New NDIS Commission Powers and Participant Protections – Commenced April and May 2026

National Disability Insurance Scheme Amendment (Integrity and Safeguarding) Act 2026 (Cth)

This Act received Royal Assent on 8 April 2026 and represents the second tranche of NDIS legislative reform. It significantly strengthens the regulatory powers of the NDIS Quality and Safeguards Commission and introduces new participant protections, including:

  • A stronger penalty framework, with a new concept of “serious contravention” attracting fines of up to $3.3 million
  • Anti-promotion orders targeting misleading or exploitative advertising
  • Expanded banning powers, now covering auditors, consultants and other influential roles
  • Broader whistleblower protections, including for former workers
  • A new minimum 90-day cooling-off period for participants wishing to exit the Scheme

Check and Update: This means providers should review their governance, conflict-of-interest and complaint-handling arrangements against the expanded powers of the NDIS Commission.

 

A few more updates from the latest edition

 That is just one entry. Here is a taste of a few more:

  • Proposed Major Structural Reform of the NDIS
    Introduced to Parliament 14 May 2026. The Government has introduced a Bill proposing significant structural reform of the NDIS, including changes to funding, planning and eligibility. It has not yet passed Parliament. 
  • Mandatory Registration for Supported Independent Living and Platform Providers 
    Commenced 1 July 2026. Mandatory registration now applies to all providers delivering Supported Independent Living supports and digital platform providers, with transitional arrangements available until 1 October 2026.
  • New Framework Planning Rules and I-CAN Support Needs Assessment Framework
    Phased rollout from April 2027. A new standardised support needs assessment tool will underpin NDIS planning, with rollout now expected from April 2027 rather than mid-2026.
  • Increase of Paid Parental Leave
    Commenced 1 July 2026. From 1 July 2026, paid parental leave increased from 120 to 130 days, with an extra 10 days available to those who claimed before that date.
